Seminar: Understanding Undesirable Medicinal Advertisement Ordinance (UMAO)/Trade Description Ordinance (TDO) for Medicinal Product Promotion

To ensure members have a thorough understanding of the relevant laws, regulations and Codes regarding medicinal material communicating to the public via different mediums, the HKAPI organises an event with law enforcement authorities and experts to explain the law and its enforcement.

On June 28th, over 200 members and NGO partners joined the morning webinar about the Undesirable Medicinal Advertisement Ordinance (UMAO), and Trade Description Ordinance (TDO) for Medicinal Product Promotion in Hong Kong.

Ms Marcia Lee, Special Counsel of Baker & McKenzie, provided an overview of the Trade Descriptions Ordinance and Broadcasting Codes, and their implications on pharmaceutical promotion. Other than the basic principles, guidelines, the possible defences to the regulations and the consequences, Marcia shared enforcement cases and case studies with HKAPI members to ensure they understood the spirit and real-life law enforcement examples.

In the second part of the Webinar, Mr Terence Man, Senior Pharmacist (Drug Information Management and Communication) of Drug Office, kickstarted the presentation, followed by his colleague Mr Terry Chan who spoke on the Understanding of Undesirable Medical Advertisements Ordinance (UMAO). At the Q&A session, members actively raised many meaningful questions regarding the UMAO updates, regulation scope and concerns around patient leaflets and drug information sharing.
